Liability Waiver & Release of Claims

1. Parties

This Waiver is entered into between Arm Your Friends, LLC ("AYF," "we," "us," "our") and the individual completing a purchase ("Participant," "you," "your"). This Waiver covers all classes, training events, range days, experiences, and related activities organized or facilitated by AYF, regardless of venue.

2. Assumption of Risk

You voluntarily choose to participate in firearms training and related activities. You understand and acknowledge that these activities involve inherent risks, including but not limited to:

• Accidental discharge of firearms
• Physical injury from firearms, ammunition, equipment, or range infrastructure
• Hearing damage from gunfire
• Injury resulting from the actions of other participants or third parties
• Property damage
• Injury or illness arising from physical exertion

You expressly assume all such risks, known and unknown, arising from your participation in any AYF activity. You confirm that your decision to participate is entirely voluntary.

3. Firearms Eligibility Self-Certification

By signing, you represent and warrant that:

• You are legally permitted to possess and handle firearms under all applicable federal, state, and local laws
• You are not prohibited from possessing firearms under 18 U.S.C. § 922(g) or any other applicable statute
• You are 18 years of age or older (21 or older for handgun activities where required by law)
• You are not under the influence of alcohol, controlled substances, or any medication that impairs judgment or physical ability
• You will immediately disclose to an instructor any change in your eligibility status before handling any firearm

AYF reserves the right to deny participation to any individual at any time, without refund, if eligibility cannot be confirmed or if any safety concern arises.

4. Release of Liability and Indemnification

To the fullest extent permitted by Texas law, you hereby release, waive, discharge, and covenant not to sue Arm Your Friends, LLC, its founders, officers, employees, instructors, contractors, volunteers, and venue partners (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury that may be sustained by you in connection with any AYF activity.

You agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorneys' fees, that may be incurred by the Released Parties arising out of or relating to your participation, your breach of any representation in this Waiver, or your violation of any applicable law or range rule.

This release applies to claims arising from the negligence of the Released Parties, except in cases of gross negligence or willful misconduct as determined by a court of competent jurisdiction.

5. Safety Compliance

You agree to follow all safety instructions issued by AYF instructors and venue staff at all times. This includes, without limitation:

• Treating every firearm as if it is loaded
• Never pointing a firearm at anything you are not willing to destroy
• Keeping your finger off the trigger until your sights are on target and you have made the decision to shoot
• Knowing your target and what is beyond it
• Wearing all required personal protective equipment (eye and ear protection) at all times on the range
• Following all range-specific rules posted or communicated by venue staff

Failure to comply with safety instructions is grounds for immediate removal from the event without refund.

6. Cancellation and No-Chargeback Policy

All sales are final. AYF does not offer refunds for cancellations made within 48 hours of a scheduled class. Cancellations made more than 48 hours in advance may be eligible for a credit toward a future class, at AYF's sole discretion.

By signing, you agree not to initiate a chargeback or payment dispute with your bank or credit card issuer for any AYF purchase. You acknowledge that your purchase confirmation, along with your agreement to this Waiver, constitutes documented authorization of the charge. In the event of an unauthorized chargeback, AYF reserves the right to pursue recovery of the disputed amount plus any associated fees.

7. Media Release

AYF may photograph or video record activities during events for educational, promotional, and documentation purposes. By participating, you grant AYF a perpetual, royalty-free, non-exclusive license to use your likeness, image, and voice in connection with AYF's marketing, social media, and educational content.

If you do not consent to being photographed or recorded, you must notify an AYF instructor in writing before the event begins. We will make reasonable efforts to accommodate your request, though we cannot guarantee complete exclusion from incidental background footage.

8. Governing Law and Dispute Resolution

This Waiver shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under this Waiver shall be resolved exclusively in the state or federal courts located in Harris County, Texas. You consent to personal jurisdiction in those courts.

If any provision of this Waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

9. Acknowledgment

By signing below, you confirm that:

• You have read this Waiver in its entirety
• You understand its terms and their legal consequences
• You are 18 years of age or older
• You are entering into this agreement freely and voluntarily
• No representations have been made to you other than those contained herein
