Liability Waiver & Release of Claims

READ CAREFULLY BEFORE SIGNING. You must read, understand, and sign this Waiver before booking any AYF class, range day, or training event. This agreement is legally binding under Texas law. If you do not agree to every section, do not sign and do not book.

1. Parties

This Waiver is entered into between Arm Your Friends, LLC ("AYF," "we," "us," "our") and the individual signing below ("Participant," "you," "your"). It covers all classes, training events, range days, run-club events, and related activities organized or facilitated by AYF, regardless of venue.

2. Assumption of Risk

You voluntarily choose to participate in firearms training and related activities. You understand and acknowledge that these activities involve inherent and significant risks, including but not limited to:

  • Accidental or negligent discharge of firearms
  • Serious bodily injury, permanent disability, or death from firearms, ammunition, equipment, or range infrastructure
  • Hearing damage from gunfire
  • Injury resulting from the actions of other participants, instructors, or third parties
  • Property damage
  • Injury or illness arising from physical exertion

You expressly assume all such risks, known and unknown, arising from your participation. Your decision to participate is entirely voluntary.

3. Firearms Eligibility Self-Certification

By signing, you represent and warrant that:

  • You are at least 18 years of age (21+ for handgun activities where required by law).
  • You are legally permitted to possess and handle firearms under all applicable federal, state, and local laws.
  • You are not prohibited from possessing firearms under 18 U.S.C. § 922(g) or any other applicable statute.
  • You are not under the influence of alcohol, controlled substances, cannabis, or any medication that impairs judgment or physical ability.
  • You will immediately disclose to an instructor any change in your eligibility status before handling any firearm.

AYF reserves the right to deny participation to any individual at any time, without refund, if eligibility cannot be confirmed or if a safety concern arises.

4. Release of Liability and Indemnification

To the fullest extent permitted by Texas law, you hereby release, waive, discharge, and covenant not to sue Arm Your Friends, LLC, its founders, officers, employees, instructors, contractors, volunteers, and venue partners (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury that may be sustained by you in connection with any AYF activity.

You agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorneys' fees, arising out of or relating to your participation, your breach of any representation in this Waiver, or your violation of any applicable law or range rule.

This release applies to claims arising from the negligence of the Released Parties, except in cases of gross negligence or willful misconduct as determined by a court of competent jurisdiction.

5. Safety Compliance

You agree to follow all safety instructions issued by AYF instructors and venue staff at all times, including:

  • Treating every firearm as if it is loaded.
  • Never pointing a firearm at anything you are not willing to destroy.
  • Keeping your finger off the trigger until your sights are on target and you have decided to shoot.
  • Knowing your target and what is beyond it.
  • Wearing required eye and ear protection at all times on the range.
  • Following all range-specific rules posted or communicated by venue staff.

Failure to comply is grounds for immediate removal from the event without refund.

6. Cancellation and No-Chargeback Acknowledgment

Training class payments are non-refundable. The exclusive remedy for missing a class is to reschedule once into a future open seat, provided you give AYF at least forty-eight (48) hours' written notice before the original class start time by emailing contact@armyourfriends.com. Late reschedules, no-shows, or arrivals more than fifteen (15) minutes after the published start time forfeit the class fee in full. Full terms in the Refund Policy.

You agree not to initiate a chargeback or payment dispute with your bank or card issuer for any AYF purchase without first contacting AYF at contact@armyourfriends.com to resolve the issue. Filing a chargeback in breach of this section may result in collections action, recovery of the disputed amount and bank fees, and a permanent ban from AYF events.

7. Media Release

AYF may photograph or video record activities during events. By signing, you grant AYF a perpetual, royalty-free, worldwide license to use your likeness, image, and voice in AYF marketing, social media, and educational content. If you do not consent to being photographed, notify the instructor in writing before the event begins. AYF will use reasonable efforts to exclude you from external imagery but cannot guarantee exclusion from incidental background footage.

8. Governing Law and Dispute Resolution

This Waiver is governed by the laws of the State of Texas. Any dispute arising under this Waiver shall be resolved exclusively in the state or federal courts located in Harris County, Texas, or by binding individual arbitration per AYF's Terms of Service. You waive any right to a jury trial or to participate in a class action. If any provision is found unenforceable, the remainder remains in full force and effect.

9. Acknowledgment

By signing below, you confirm that:

  • You have read this Waiver in its entirety.
  • You understand its terms and their legal consequences.
  • You are at least 18 years of age.
  • You are entering into this agreement freely and voluntarily.
  • No representations have been made to you other than those contained herein.
